Volunteer Waiver

While participating as a volunteer or event participant with Lake Michigan Bird Observatory, I acknowledge and agree that:

1. There exist numerous risks of injury from the activity, including serious injury or sickness, and while equipment and personal discipline may reduce this risk, the risk of serious injury does exist; There exist potential natural hazards that may exacerbate those risks.
2. I certify that I am sufficiently physically fit to participate in the event or activities.
3. I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the releases or others and assume full responsibility for my participation.
4. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and immediately inform LMBO staff.
5. I, for myself and on behalf of my heirs, assigns, personal representative or next of kin, agree not to sue and instead hereby release and hold harmless the organizers, including LMBO and all those associated, and its officers, directors, agents and/or employees, other participants, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct event or activity (releasees), with respect to any and all injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the releasees or otherwise; and
6. In addition, I hereby grant full permission to LMBO,
   1. To use my name and any photographs or videos taken of me in connection with the event or activity for all legitimate purposes without any monetary payment to me.
   2. To contact me about LMBO projects and programs, volunteer opportunities and upcoming events.

I ACKNOWLEDGE THAT I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY AND PHOTO PERMISSION AND HAVE BEEN GIVEN REASONABLE OPPORTUNITY TO DISCUSS THIS WITH MY LEGAL COUNSEL.  FURTHER, I ACKNOWLEDGE THAT I FULLY UNDERSTAND THE TERMS OF THIS WAIVER AND RELEASE OF LIABILITY AND THAT I HAVE SIGNED IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, GUARANTEE OR ORAL REPRESENTATION BEING MADE.
