In consideration of being permitted to participate in any way in an activity of the Delaware Highlands Conservancy I, for myself, my personal representatives, administrators, heirs, assigns and next of kin, hereby execute this Release of Liability (“Release”) in favor of the Delaware Highlands Conservancy and/or its agents (collectively “Conservancy”).
By signing below, I agree to all the conditions stated herein, and accept all legal liability associated with participation in the Activity. I understand that risks and hazards, foreseen and unforeseen are an inherent part of any such outdoor activity, and I assume all liability for any bodily injury or property damage which may occur as a result of accidents or injuries. These risks may be caused by my actions or by inactions of others, and may result in social or economic losses, costs and damages which have resulted from participating in the Activity. I fully accept and assume all such risks and responsibility for losses, costs, and damages incurred as a result of participation in the Activity. I understand the nature of outdoor activity and acknowledge and agree that I am in good health and proper physical condition to participate.
I voluntarily assume the risk of injury or even death while participating in the Activity. If I am injured, I authorize the Conservancy to provide or seek emergency first aid and any medical or first aid personnel to provide medical care until such time as I or someone authorized by my medical care power of attorney or otherwise by law is able to act on my behalf.
I hereby release, discharge and covenant not to sue Delaware Highlands Conservancy, its directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the Activity takes place, collectively referred to as “RELEASEES” herein, from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the “RELEASEES” to the full extent permitted by law.
By signing below, I also give permission for the Delaware Highlands Conservancy to use photographs from this event in publications, on the website, on social media, and in press releases to newspapers.
