Participant & Volunteer Waiver

is executed on the day and year first written below by the undersigned (“Participant” or "I") in favor of Mahoosuc Land Trust, a Maine nonprofit corporation, its directors, officers, employees, volunteers, agents, successors, and assigns (“MLT”).

Participant desires to work as a volunteer for MLT and/or participate in MLT events and engage in the activities related to being a volunteer or participant (the “Activities”), and may include monitoring properties protected by MLT, doing maintenance and construction on MLT properties, working in MLT offices, and participating in workshops, hikes, field trips, special events and MLT fundraisers.

Participant hereby freely, voluntarily, and without duress executes this Release under the following terms:

RELEASE AND WAIVER. I do hereby release and forever discharge and hold harmless the MLT from any and all liability, claims, and demands of whatever kind or nature which arise or may hereafter arise from the Activities.

I understand that this Release discharges MLT from any liability or claim that I may have against the MLT with respect to any and all claims for bodily injury, illness, death, or property damage from any cause, including negligence, that may result from the Activities. I also understands that MLT does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury, illness, death or property damage.

ASSUMPTION OF THE RISK. I understand that the Activities may include work or activities on an ongoing basis without supervision that may be hazardous to me, including, but not limited to, working outdoors, difficult conditions, uneven terrain, unanticipated natural hazards, use of equipment (including power tools), strenuous manual labor, moving materials (some of which may be heavy), and transportation to and from MLT properties. I hereby expressly and specifically assume the risk of injury or harm in the Activities.

MEDICAL TREATMENT. I do hereby release and forever discharge MLT from any claim whatsoever which arises or may hereafter arise on account of any first aid, treatment, or service rendered in connection with my Activities with MLT or with the decision by any representative or agent of MLT to exercise the power to consent to medical treatment as such power may be granted and authorized in the below Parental Authorization for Supervision and Treatment of a Minor Child.

COVID-19. I agree not to participate if I:

1)  Have a suspected or confirmed case of COVID-19; or 

2)  Have been exposed to any person with a suspected or confirmed case of COVID-19.

3)  Cannot meet the guidelines provided by the United States’ Centers for Disease Control and Prevention (CDC); or

4)  Experiences symptoms of COVID-19, including but not limited to those provided by the (CDC):

COVID-19 symptoms may appear 2-14 days after exposure to the virus, may be mild or severe, and may include: Cough, Shortness of breath or difficulty breathing, Fever, Chills, Muscle pain, Sore throat, New loss of taste or smell. Other less common symptoms include gastrointestinal symptoms like nausea, vomiting or diarrhea.

I also understand and acknowledge that the virus that results in COVID-19 can occur in all environments, including on the grounds and facilities of MLT and during MLT activities. I acknowledge and agree that it is my sole responsibility to take all steps necessary to safeguard myself from possible exposure. I understand and agree that by engaging with and in the activities offered by MLT, I am accepting and assuming the risk that I may be exposed to COVID-19 or other disease processes.

I understand and accept the risk that I may become ill, potentially with permanent injuries, loss of function or other physical, mental or other permanent impairment, or that I may die, or that I may infect others who may suffer these consequences, or some combination of the foregoing or other injuries currently not widely known.  

OTHER. I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Maine, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Maine. I agree that this Release shall also be binding upon my heirs, executors, administrators, and assigns.

It is the policy of the Mahoosuc Land Trust that ultra-hazardous activity such as using power tools is not permitted by anyone under the age of 18. Further, the Mahoosuc Land Trust will not provide transportation for anyone under the age of 18. Minors under the age of 16 may only participate if accompanied by a parent or guardian.

PARENTAL AUTHORIZATION FOR SUPERVISION AND TREATMENT OF A MINOR CHILD

I am the parent or legal guardian having custody of the participant, a minor child. As such parent or legal guardian, I hereby authorize and
appoint myself or, in my absence the Participant's chaperone named below, an adult in whose care the minor child has been entrusted, as my agent to act for me with respect to my minor child and in my name in any way I could act in person to make any and all decisions for me with respect to my minor child, concerning my minor child’s supervision, personal care, medical treatment, hospitalization, and health care and to require, withhold or withdraw any type of medical treatment or procedure which may be rendered to my minor child under the supervision and on the advice of any physician licensed to practice in the state in which treatment is sought.

By clicking "Submit" below, I, as parent or guardian of the Participant named above, give my permission for the Participant to participate in these Activities, and also agree, on behalf of myself and the Participant, to all the terms of this Release.
